MindDesk Terms of Service
1. Service Description
MindDesk is a browser extension that helps users organize, save, and reuse prompts and responses from AI websites.
Account registration is free. The extension's features are available only during an active free trial or after purchasing access. When access is not active, the content library and current tasks are locked. See Section 3 for details about free trials and paid access.
2. Accounts
The Service is intended for adults aged 18 or older. You must confirm that you are at least 18 years old when registering. Minors may not register for or use the Service.
Registration requires a valid email address and email verification. You are responsible for keeping your password secure. Activities performed through your account will be treated as activities performed by you.
There is no limit on the total number of devices you may sign in to, but the number of devices that may remain signed in simultaneously is limited according to your plan. If the limit has been reached, signing in on a new device will automatically sign out the device that signed in earliest. That device will need to sign in again to resume use.
3. Payments and Free Trial
Local Feature Access: Paid local features are unlocked through a single payment. This purchase unlocks the paid local features of the current major version (1.x) and includes one complimentary month of cloud service.
Cloud Service: After purchasing local feature access, you may subscribe to the cloud service on a monthly basis. You may cancel your subscription at any time. Following cancellation, the cloud service remains available until the end of the current billing period.
Free Trial: New accounts receive a 7-day free trial. The trial includes local features only and does not include cloud service. No payment method is required. Each account and each device is eligible for only one free trial.
Immediate Access and Right of Withdrawal: Local feature access and cloud service are digital content or digital services made available immediately after payment. At checkout, you must expressly confirm the following:
“I agree to immediate access to the service and understand that I thereby waive my right of withdrawal.”
Local Feature Access: Once you have provided this confirmation and local feature activation is complete, the digital content is considered delivered. You will no longer be entitled to exercise any statutory right of withdrawal, such as the 14-day withdrawal right under European Union law.
Cloud Service: The service begins immediately after your confirmation. If applicable law in your jurisdiction grants you a right of withdrawal and you exercise that right within the applicable withdrawal period, we will refund the amount paid minus a proportional charge for the days of service already used.
If you do not provide the confirmation described above, any right of withdrawal granted to you by applicable law remains unaffected.
Refund Policy — Local Features: Purchases of local feature access are generally non-refundable once activation is complete. Exceptions include duplicate charges, incorrect charges, and circumstances in which a refund is required by applicable law.
Refund Policy — Cloud Service: Cloud service is billed monthly, and you may cancel your subscription at any time. No further charges will be made for subsequent billing periods after cancellation. You may continue using the service until the end of the period already paid for. No prorated refunds are provided for unused time in the current billing period, except in cases of duplicate charges, incorrect charges, or where a refund is required by applicable law.
Refund Requests: To request a refund, please email the support address listed in Section 8 and include your order information. Once your request is confirmed to meet the applicable refund conditions, the refund will be processed through Creem. The time required for the refund to reach your account depends on your payment method and payment service provider.
Payments are processed by Creem, which acts as the seller. When a refund is completed, the corresponding access rights will be revoked. If a purchase of local feature access is refunded, the complimentary cloud service included with that purchase will also be revoked.
Nothing in this section limits any rights granted to consumers under applicable law.
4. Your Content
The prompts and responses you save belong to you. You grant us permission to store and transmit this content solely for the purpose of providing the Service. We will not use your content for any other purpose.
After your cloud service subscription expires, your cloud data will continue to be retained. For 90 days after expiration, you may view your cloud data and import it into your local environment. If we need to delete your data after this period, we will notify you by email in advance.
5. Acceptable Use
You must not:
• Share your account with multiple users.
• Bypass device limits or paid access restrictions.
• Modify and distribute unauthorized or cracked versions of the extension.
• Attack, disrupt, or interfere with the Service.
• Upload illegal content.
We may suspend or terminate your account if you violate these restrictions.
6. Service Changes and Termination
We may modify, upgrade, or discontinue certain features of the Service. Before discontinuing the cloud service, we will notify you in advance and provide time for you to export your data.
You may delete your account at any time. For details about account and data deletion, please refer to Section 6 of our Privacy Policy.
If we discontinue the Service entirely, we will notify users in advance by email. Local features require periodic license verification through our servers. As a result, local features may also become unavailable when the Service is discontinued. Fees paid for local feature access will not be refunded solely because of such discontinuation, except where otherwise required by mandatory provisions of applicable law.
7. Disclaimers and Limitation of Liability
The Service is provided on an "as is" basis.
The extension depends on third-party AI websites, including ChatGPT and Claude. Changes to these websites, restrictions on content access, or changes to their policies may cause some or all features of the Service to become unavailable.
If features become unavailable due to changes to third-party websites, third-party policies, or events beyond our reasonable control, we will make reasonable efforts to resolve the issue but do not guarantee uninterrupted availability. Such circumstances do not, by themselves, entitle users to a refund for local feature access, except where otherwise required by mandatory provisions of applicable law.
To the extent permitted by applicable law, we are not liable for indirect damages. Our total liability shall not exceed the amount you actually paid for the Service during the 12 months immediately preceding the relevant claim.
